Employment law in Dubai: which rules apply to you
The law that governs your job in Dubai depends on where your employer is licensed.
- Mainland Dubai: Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations and its Executive Regulations. Complaints start with the Ministry of Human Resources and Emiratisation (MOHRE), and claims that do not settle go to the labour circuits of the Dubai Courts.
- Other Dubai free zones, such as JAFZA and DMCC: the federal Labour Law applies here too, but a complaint usually starts with the free-zone authority rather than MOHRE.
- DIFC: its own Employment Law (DIFC Law No. 2 of 2019). Claims are heard by the DIFC Courts, often in the Small Claims Tribunal, and end-of-service is paid through the DEWS savings plan instead of a gratuity.
How a labour claim works in Dubai
- The complaint is filed with MOHRE, online or at a Tasheel or Tawafuq centre. MOHRE first tries to settle it.
- If the claim is AED 50,000 or less, MOHRE decides it. Either side can challenge that decision before the Court of First Instance within 15 working days.
- Larger claims, and those that do not settle, go to the Dubai Courts. Employee claims up to AED 100,000 carry no court fees.
- A claim must be brought within two years of the end of employment.
