UAE legal provisions dealing with construction contracts are confined to a short chapter in the Civil Transactions Code that have not been updated since the 50’s of the 20th century. It has fell far from matching the big leap that UAE has achieved in the construction sector. Owing to this fact, many of the provisions that are used in FIDIC contracts stand in conflict with binging provision of UAE construction law. This makes construction case-law essential in interpreting clauses in construction contracts based on the FIDIC or other applicable forms.
